Validity of premises licence
A premises licence has effect until such time as:
- it is revoked, or
- if it specifies that it has effect for a limited period, that period expires.
But a premises licence does not have effect during any period when it is suspended
Death, incapacity, insolvency etc. of licence holder
A premises licence lapses if the holder of the licence;
- dies,
- becomes a person who lacks capacity to hold the licence,
- becomes insolvent,
- is dissolved, or
- if it is a club, ceases to be a recognised club.
A premises licence also lapses if the holder of the licence ceases to be entitled to work in the United Kingdom at a time when the holder of the licence is resident in the United Kingdom (or becomes so resident without being entitled to work in the United Kingdom).
Interimauthority notice: If a premises licence lapses due to any of above reasons a person who has a prescribed interes in the premises concerned, or is connected to the person who held the premises licence immediately before it lapsed (“the former holder”), may give to the relevant licensing authority an “interim authority notice” in respect of the licence. This needs to be done within the 28 days of the licence lapses.
Interim authority period: means the period beginning with the day on which the interim authority notice is received by the relevant licensing authority and ending three months after that day, or if earlier, when it is terminated by the person who gave the interim authority notice notifying the relevant licensing authority to that effect; or the licence has been transferred.
Surrender of premises licence; Where the holder of a premises licence wishes to surrender his licence he may give the relevant licensing authority a notice to that effect.
