Sale of alcohol by retail
The sale of alcohol by retail is a sale of alcohol to any person except those described as wholesalers. Any other sale of alcohol is a sale of alcohol by retail regardless of the quantity of alcohol purchased. The sale of alcohol includes events where alcohol is included in the ticket price or no specific price is quoted per drink but donations are requested or accepted for the alcohol. This includes charity events.
It is an offence to display alcohol for an unauthorised sale.
In order to sell alcohol by retail, there are mandotary conditions:
- A valid premises license or temporary event notice,
- An appointed designated premises supervisor (who is a personal licence holder). This does not apply to some community centers.
- Only 1 DPS can be appointed on a premises licence.
Alcohol cannot be sold in a premises if a DPS is not appointed on the premises license, or if the DPS’s personal license has been suspended or forfeited.
Selling alcoholic beverages by ordering online
A license is not required for an office ordered online or by phone, but it is necessary to both obtain a premises license and an appointed DPS to the warehouse holding alcoholic beverages to fulfill orders. The process related to the delivery of alcohol to the address should be reported to the licensing authority, if necessary, some license conditions may be requested by the authorities. Door-to-door, home delivery sales of alcohol cannot take place from a vehicle or a moving structure.
Community Premises
For community premises, such as village halls, the premises license holder is the committee management . This board is responsible for supervising and authorizing alcohol sales. There are no requirements for DPS.
