Rights of a Personal Licence Holder
- A Personal Licence Holder may refuse to serve a customer.
- Can not discriminate while refusing to serve.
- He does not have to give reasons for refusing to serve.
- He can ask the unwanted customer to get out of the premises.
- He may prohibit certain customers from entering the business for a certain period of time.
Selling alcohol to a drunk person is an offense under the Licensing Act 2003, and the following acts are also offences:
- Getting drunk on a licensed premises – including Premises License holder
- Allowing the drunk to stay in the licensed premises
- Condoning drunkenness and aggression within the licensed premises
It is a crime to sell or allow alcohol to be sold to a drunk person. Alcohol should not be sold or served if it can be consumed by an intoxicated person.
