Persistently selling alcohol to children
A person is guilty of an offence if;
- on 2 or more different occasions within a period of 3 consecutive months alcohol is unlawfully sold on the same premises to an individual aged under 18;
- at the time of each sale the premises were either licensed premises or authorised under TEN
- that person was a responsible person in relation to the premises at each such time.
A defence of due diligence will not be accepted for repeated under – 18 sales. The premise may face unlimited fines, and a suspension for the Premises licence up to three months. Instead of being sued, an alternative to voluntarily closing the business for 2 to 14 days can be offered.
